Repositories of tissues, cell lines, blood samples, and other biological specimens are crucial to genomics, proteomics, and other emerging forms of biomedical research. Creation of these repositories by individual researchers and their affiliated organizations, commercial entities, and even governments has been labeled “biobanking” in the bioethics literature. Biobanking as a metaphor for the collection, transfer, and use of these specimens suggests a framework for the legal response to conflicts that may arise - one embedded in principles of contract law and (...) property ownership with an overlay of legislatively authorized regulation of the “industry.”. In this paper, I consider whether we should offer assistance to both wild and domesticated animals when they are suffering. I argue that we may have different obligations to assist wild and domesticated animals because they have different morally-relevant relationships with us. I explain how different approaches to animal ethics, which, for simplicity, I call capacity-oriented and context-oriented, address questions about animal assistance differently. I then defend a broadly context-oriented approach, on which we have special obligations to assist animals that (...) we have made vulnerable to or dependent on us. This means that we should normally help suffering domesticated animals, but that we lack general obligations to assist wild animals, since we are not responsible for their vulnerability. However, we may have special obligations to help wild animals where we have made them vulnerable to or dependent on us. I consider some obvious difficulties with this context-oriented approach, and I conclude by looking more closely at the question whether we should intervene, if we could do so successfully, to reduce wild animal suffering by reducing predation. Spirituality and religion are not synonymous and, in fact, require not only different definitions but also appropriate vocabulary. A deeper discussion of the issues concerning spirituality ensues in several sections: 1) fundamental differences between spirituality and religion; 2) brain operations relative to transcendent states; 3) a definition of consciousness; 4) music, culture, and transcendence; 5) transcendence; 6) transcendence through music, and 7) spirituality in music education. Idealogically motivated responses to the Bishops' Letter have heightened the divisiveness of subsequent dialogue at the expense of its rigor. Schumpeter's metaphor of creative destruction provides a vehicle for reconciliation between advocates of politics and markets. His most distinguishing characteristic of capitalism extols its productive and dynamic properties. It underscores its relentless and unmanageable side that transforms institutional structures as well. The capitalist engine is driven by a perennial gale that creates and destroys at the same time; thus there is (...) a necessary role for both entrepreneurs and planners in a mixed economy. The bishops' call for collaboration is also subject to the Schumpeterian metaphor. Major process changes without new institutional forms are inconsistent with the historical experience of U.S. pluralist society. (shrink)

Abstract In his critique of modern libertarian thinking, Jeffrey Friedman (1997) argues that libertarian moral theory makes social science irrelevant. However, if its moral claims are hypothetical rather than categorical imperatives, then economics, history, sociology, and other disciplines play a central role in libertarian thought. Limitations on human knowledge necessitate abstractly formulated rules, among which are claims of rights. Further, Friedman's remarks on freedom rest on an erroneous understanding of the role of definitions in philosophy, and his characterization of the (...) ?right to do wrong? as a ?logical contradiction? reveals a misunderstanding of logic. Chapter 47 contains a sentence which has been the subject of a good deal of controversy and is manifestly corrupt. In the codex it reads as follows: κα τοᾁτων πνω μαιμᾃτατον θνος Bακτριανν π βασιλα οσαν διον τπον κα 'Aλξανδρος ρμηθες π τν μερν τοᾁτων ρι τοȗ Γγγον διλθε κτλ. Attempts have been made to connect this sentence with the rulers of the Kushan dynasty. It has even been suggested that οσαν represents Kονσαν : the suggestion naturally won no acceptance, (...) but one may point out that in any case it failed to attack the real difficulty, which lies in the words διον τπον On that essential point, the views of recent editors have both varied and combined. The expression used in the Periplus M.E. has attracted a certain amount of attention. It is generally held to mean ‘a legal mart where foreign trade was officially allowed and taxed’ : and this translation has sometimes been made the ground of comparison with the treaty ports of China or the échelles of the Levant. On closer examination of the usage of the Periplus M.E. it seems difficult to accept this meaning, and possible to suggest another.

“It is almost impossible for a working neurologist to think clearly about the functions of the highest centres because the counters of thought, the words he must employ—are often of psychological origin and for the most part meaningless.”.

Frege famously argued that truth is not a property or relation. In the “Notes on Logic” Wittgenstein emphasised the bi-polarity of propositions which he called their sense. He argued that “propositions by virtue of sense cannot have predicates or relations.” This led to his fundamental thought that the logical constants do not represent predicates or relations. The idea, however, has wider ramifications than that. It is not just that propositions cannot have relations to other propositions but also that they cannot (...) have relations to anything at all. The paper explores the consequences of this insight for the way in which we should read the Tractatus. In the “Notes on Logic” the insight led to Wittgenstein's emphasis on “facts” in any attempt to understand the nature of symbolism. This emphasis is continued in the Tractatus. It is central to his view that propositions are facts which picture facts which prevent us from construing such picturing as a relation between what pictures and what is pictured. It illuminates the importance of context principle with regard to the distinction between showing and saying to which Wittgenstein attached so much importance and it underlies the non-relational view of psychological propositions which he advocates. Finally, if propositions by virtue of sense cannot have predicates or relations the paradox at the end of a work which consist largely of propositions about propositions becomes intelligible. In Reasons and Persons, Derek Parfit argues for a Reductionist View of personal identity. According to a Reductionist, persons are nothing over and above the existence of certain mental and/or physical states and their various relations. Given this, Parfit believes that facts about personal identity just consist in more particular facts concerning psychological continuity and/or connectedness, and thus that personal identity can be reduced to this continuity and/or connectedness. Parfit is aware that his view of personal identity is contrary to (...) what many people ordinarily think about persons, and thus if his view is correct, many of us have false beliefs about personal identity. Further, since many of our views about morality are based upon our views about personal identity, it follows that we may also have to change our beliefs about morality as well. Parfit, however, thinks that in many cases such changes represent an improvement over our former beliefs and better fit with our considered moral judgments. But instead, I argue that Parfit’s account poses a serious threat to considered moral judgments, and, in particular, that it seriously undermines any substantial notion of moral commitment. As such, even if Parfit is metaphysically correct, I suggest we may have practical reasons, based on our moral concerns, for holding to a more weighty view of the nature of persons. (shrink)

This paper explores the idea of 'respect for nature' in the Earth Charter. It maintains that the Earth Charter proposes a broadly holistic environmental ethic where, in situations of conflict, species are given ethical priority over the lives of individual sentient organisms. The paper considers policy implications of this perspective, looking by means of example at the current European environmental policy dispute about the ruddy and white-headed duck. Questions about the value of species and biological diversity this raises are explored. (...) This article elucidates some connections and divergences between S.N. Eisenstadt’s work on multiple modernities and critical reflections on ‘African modernity’ presented by Africanist scholars. It argues that there is more cross-over between these discussions than is commonly thought when both are seen as parallel responses to the shortcomings of post-war modernization theory. Eisenstadt’s work can inform debates in African Studies concerning the effective power of tradition in postcolonial African societies, and on African interpretations of the ‘cultural programme’ of modernity. The (...) article also discusses some weaknesses in Eisenstadt’s theorizing which arise from an extension of the multiple modernities framework to African societies, namely, an underappreciation of the various modalities of colonial imperialism and racialization, as well as the institutional constraints placed on postcolonial societal elites. It claims that these can be offset via a dialogue with the work of scholars in African Studies. Moreover, it is argued that the paradigm of multiple modernities can more satisfactorily shed light on African trajectories of modernity via the retrieval of tenets of Eisenstadt’s ‘heterodox’ modernization theory and work on post-traditionality, outlined in the 1960s and the 1970s, which include specific reflections on African societies. Introduction to the World Government /World Governance symposium.

This article explores the tension between the fundamental perception that the provision of privatized services such as health and social care remain inherently public and the absence of any clearly developed juridical concept of ‘public services’ as the basis of judicial control in accordance with public law standards. In a series of recent cases, courts have had the opportunity to determine whether private contractors engaged in the provision of local authority residential and social care services are amenable to judicial review (...) or susceptible to direct vertical proceedings under the Human Rights Act, on grounds that they are performing functions which are by their very nature quintessentially public. However, conflating questions of amenability to review and susceptibility to the Human Rights Act (hereafter HRA), courts have refused to adopt a test based on the public character of a body's functions, irrespective of the source of power. This article acknowledges the constitutional propriety and rationality of a broad based functional test of review. Nevertheless, it is argued that if courts continue to resist such a test, Parliament must legislate to ensure judicial regulation of decisions by independent contractors of health and social care services, in accordance with public law principles and HRA obligations, which transcend the boundaries of their strict contractual undertakings. Why might alternative taxonomies be needed in contemporary life, and how might the notion of categorisation or anti-categorisation be thought speculatively? This essay considers some of the ways that life and matter have been historically divided and segmented and asks how this might be rendered mobile, offering new divisions and definitions for those who exist outside hegemonic segments or scales.

We agree with Faunce’s proposal that academic legitimacy is important in ensuring that whistle-blowing is included in medical curricula. We disagree, however, with the assertion that this is best achieved by means of an over-arching theoretical foundation for health care whistle-blowing of the kind suggested by Faunce. We propose that systematic theoretical justification is neither the sole nor the main determinant of academic legitimacy when it comes to matters for inclusion in medical school curricula, and outline an alternative view, together (...) with a practical example of a healthcare whistle-blowing topic. Andrews et al. present a clear discussion of the various criteria needed to identify adaptations. However, they also imply a history of the debate between adaptationists and their critics that is incomplete. The history implied is one of only genuine scientific disagreement. This neglects the role of nonscientific motives and strawman arguments on behalf of the critics of adaptationists.

Contrary to the assumption of arbitrariness in modern linguistics, sound symbolism, which is the non-arbitrary relationship between sounds and meanings, exists. Sound symbolism, including the “Bouba–Kiki” effect, implies the universality of such relationships; individuals from different cultural and linguistic backgrounds can similarly relate sound-symbolic words to referents, although the extent of these similarities remains to be fully understood. Here, we examined if subjects from different countries could similarly infer the surface texture properties from words that sound-symbolically represent hardness in Japanese. (...) We prepared Japanese sound-symbolic words of which novelty was manipulated by a genetic algorithm. Japanese speakers in Japan and English speakers in both Singapore and the United States rated these words based on surface texture properties, as well as familiarity. The results show that hardness-related words were rated as harder and rougher than softness-related words, regardless of novelty and countries. Multivariate analyses of the ratings classified the hardness-related words along the hardness-softness dimension at over 80% accuracy, regardless of country. Multiple regression analyses revealed that the number of speech sounds /g/ and /k/ predicted the ratings of the surface texture properties in non-Japanese countries, suggesting a systematic relationship between phonetic features of a word and perceptual quality represented by the word across culturally and linguistically diverse samples.
